Overview

Annabel has extensive experience of acting for the defence in a wide range of serious and complex criminal trials and appeals.

Annabel has particular expertise in cases involving political protest. In 2011 she was junior counsel for 9 of the 10 defendants in the first trial of the Fortnum and Mason protests during the TUC march against the cuts. This case is currently on appeal to the High Court. Annabel is instructed as junior counsel in the next two multi-handed trials arising out of the same protest due to be tried in March 2012. Annabel also represented the late Brian Haw in relation to prosecutions under SOCPA

Annabel is often instructed to represent young and vulnerable clients. She recently acted for a child charged with sexual offences against an 11 year old girl. The defendant had an IQ of 49 and the proceedings were eventually stayed.

Annabel also accepts instructions in cases involving financial crime. She has extensive experience representing foreign nationals prosecuted under the Fraud Act 2006 for false identification documents. She also acts in POCA proceedings.

In tandem with her trial work Annabel has a growing appellant practice. She regularly advises on appeals in capital cases both in the US and to the Privy Council. She was recently led by Geoffrey Robertson QC in the Court of Appeal in the case of Victor Mears, the owner of the Lapland theme park prosecuted under the Consumer Protection from Trading Standards Regulations 2008. The conviction was quashed on the grounds of apparent juror bias [R v Mears [2011] EWCA Crim 2651]. Annabel is a contributing author to the forthcoming Lexis Practice notes on Appeals to the Supreme Court.

Annabel also regularly acts for serving prisoners in adjudications and parole board hearings and advises on judicial review of parole board decisions.

She is also instructed by the armed forces to represent soldiers facing courts martial.

Before coming to the Bar Annabel worked on capital murder trials in Mississippi. She is Chair of the Amicus executive committee, a charity that trains and sends lawyers and students to the US to work on capital cases.

  • R v Bauer and Ors - first trial of the 'Fortnum and Mason protesters', currently on appeal to the High Court on point of law concerning the remit of joint enterprise and interpretation of the law of Aggravated Trespass

  • R v Mears [2011] EWCA Crim 2651 - led junior in appeal against conviction for offences under the Consumer Protection from Unfair Trading Regulations 2008. Convictions quashed on grounds of apparent jury bias

  • R v Bentall [2009] EWCA Crim 1730 - appeal against sentence [CCRC referral on a point of law concerning remand time and the setting of the minimum tariff in life sentences]

  • R v Wilson [2009] - appeal against sentence [case concerning the relationship between remand time, administrative recall and s116 orders]

Regulatory and Financial Crime

  • R v Ayonrinde, St Albans Crown Court [2011] - Insurance Fraud, dismissed at half time after successful submission of no case to answer

  • R v Farkas and anor, Central Criminal Court [2011] - 6 Counts of Fraud [Lebanese loops], sentenced to a conditional discharge for 2 years

  • R v Wilcock, Hove Crown Court [2011] - Sri Lankan national charged with possession of false identification documents, sentenced to a suspended sentence

  • R v Morris, Bristol Crown Court [2011] - POCA proceedings involving alleged benefit figure of £1,345,087

Protest Cases

  • R v Bauer and Ors, City of Westminster Magistrates Court [ongoing] - Together with Richard Thomas represented 9 of 10 defendants charged with aggravated trespass arising out of the alleged sit in at Fortnum and Mason. The case is currently on appeal to the High Court

  • R v Collins, Bournemouth Magistrates Court [2011] - represented the 'naked cyclist' on charges of public order

  • R v Haw and Tucker [2009] - prosecution under SOCPA for use of a loudhailer

  • R v O [a child], Ealing Youth Court [2012] - sexual assault on 11 year old child. Defendant with severe learning difficulties and an IQ of 49. Proceedings stayed by district judge in light of issues surrounding fitness to plead

  • R v Hamilton, Inner London Crown Court [2012] - Possession with Intent to supply Class A and possession of Criminal Property, successful half time submission of no case to answer.

  • R v Kiddane, Harrow Crown Court [2012] - Theft from employer, proceedings stayed as abuse of process for destruction of CCTV evidence

  • R v C [a child] and ors, Southwark Crown Court [2011] - Child defendant charged with s18 and two counts of robbery on children

  • R v Sakyi, Snaresbrook Crown Court [2011] - Robbery and Possession of a Firearm

  • R v Glensman, Snaresbrook Crown Court [2011] - Robbery and ABH on a taxi driver

  • R v Messam and Anor, Isleworth Crown Court [2011] - Possession with Intent to Supply Class A [Heroine and Cocaine]

  • R v Hay, Harrow Crown Court [2011] - Possession with Intent to Supply Class A

  • R v Wood and Ors, St Albans Crown Court [2011] - Multi Handed Conspiracy to Supply Class C, defendant sentenced to community order

  • R v Deria, Inner London Crown Court [2011] - Burglary. Successful submission of no case to answer despite DNA evidence placing the defendant in the building

  • R v McCarthy, Southwark Crown Court [2011] - Domestic burglary, defendant with additional 38 TICs for domestic burglary, sentenced to 9 months custody suspended for 2 yearsOverview
