Overview:

Eloise practises in the areas of clinical and professional negligence, public law and inquests, personal injury, employment, regulatory law and general civil law. She is a former solicitor who spent several years working for South West London Law Centres.

Clinical and Professional Negligence

Eloise is instructed by solicitors on a wide range of clinical and professional negligence matters. Examples of her recent and current work include:

  • VN v Chesterfield and North Derbyshire Royal Hospital NHS Trust led by Christopher Gibson QC: late diagnosis of subdural empyema.
  • L v City Hospitals Sunderland NHS Foundation Trust: strike-out application in a cerebral palsy case worth in the region of £3,000,000.
  • Re H: a professional negligence matter involving a non-practising barrister facing allegations of holding himself out as a barrister and of failing to check documents with the result that a fraud was committed.
  • Re JW: delay in diagnosing a brain tumour, raising various novel quantum issues.
  • R v O: clinical negligence trial concerning an allegedly negligent failure to suspect a deep infection following orthopaedic surgery.

Public Law and Inquests

Eloise practises in public law matters including human rights claims and civil actions against bodies such as prisons, security services and health authorities.

Eloise's inquest practice includes deaths in hospital, deaths in custody and deaths raising issues of the adequacy of social or medical care. Her practice encompasses article 2 compliant inquests, jury inquests and inquests raising issues of wider public importance.

Some examples of her recent and current cases include:

  • A death due to misuse of diabetic medication, raising systemic concerns including the failure to provide a consultant-led diabetic service in the community. Eloise acted for the family at the inquest, where a neglect verdict was received. She is presently acting for the family in a claim against the relevant health authorities under the Human Rights Act.
  • A death in custody following an assault by a cell-mate. Eloise acted for the family at the inquest and is presently acting for the family in a claim under the Human Rights Act.
  • A death in hospital following the transplant of a CMV-positive kidney into a CMV-negative patient. Eloise represented the family at the inquest and is presently acting in their clinical negligence claim.

Eloise is a member of the AvMA Inquests Project.


Personal Injury

Eloise regularly practises in all areas of multi-track and fast-track personal injury work, including employers' liability, public liability, road traffic accidents (including MIB arbitrations), occupiers' liability, sports injury and asbestosis cases. She has a particular interest in employers' liability and industrial disease.

Where appropriate, Eloise is happy to undertake personal injury and clinical negligence work on a Conditional Fee Agreement.

Employment and Regulatory Law

Eloise practises in regulatory law cases involving barristers and solicitors (including trainees and non-practising barristers.) Eloise also practises in regulatory law in the field of healthcare, including Nursing and Midwifery Council and Health Professions Council work.

Eloise practises in employment and discrimination law, including work at EAT level. She is particularly interested in cases with a medical dimension, such as stress at work cases.

General civil law

Eloise practises in other areas of civil law, including contract disputes, costs matters and actions for breach of confidence. She also advises clubs and societies on issues such as constitution and membership.

Other activities:

Eloise is an experienced lecturer and trainer. Before joining Doughty Street, she was the Programme Leader of the part time Bar Vocational Course at BPP Law School. She has also taught and supervised LLM students.~

Eloise has delivered training for LawWorks (the Solicitors' Pro Bono Unit.) She has devised and delivered training sessions for medical expert witnesses for the Helen Bamber Foundation, a charity which assists victims of torture.
Eloise is a member of AvMA, PNBA and Justice.
