John Walsh

John Walsh is a specialist practitioner in immigration and prison law. He has acted as counsel before numerous tribunals and higher courts and European Court of Justice.

His reported cases include: R v Secretary of State for the Home Department ex parte Yennin [1995] Imm AR 93 (on rights of dependants of EU nationals to enter the UK); M v Secretary of State for the Home Department [1996] 1 All ER 870 (fact of having made an asylum claim can be ground for refugee status); Savas v United Kingdom [2000] 1 W.L.R 1828 (leading case on the effect of the Ankara-EC Agreement on self-employed businesses in the UK); R v Secretary of State ex parte Carpenter [2003] W.L.R 267 (leading case on the rights of businessmen doing business throughout the European Union to bring their third country spouses to the UK; Pardeepan [2000] INLR 447 (on rights of immigrants to pursue human rights claims in the UK); R v Crown Prosecution Service ex parte Pepushi [2004] EWHC 798 (on rights of asylum seekers not to be prosecuted for possession of false documents on entering the UK); R v Secretary of State for the Home Department ex parte Balamurali [2003] EWCA 1806 (on powers of the Home Office to certify as unfounded repeated human rights claims); Theophilius v London Borough of Lewisham [2002] E.L.R. 231 (on legitimate education and rights of students to grants for third level education).

He is a member of Immigration Law Practitioners Association, Bar European Group and Constitutional and Administrative Law Bar Association. He is involved with many voluntary associations including Planning Aid for London and Irish Commission for Prisoners Overseas. He is a reviewer for the Bar Pro Bono Unit and is a pupil master in chambers. He is a student of Canon Law. He has been listed on Chambers and Partners Directory for several years now as a leading junior. The Directory reported the following comments by reviewers:
