 Judith Farbey

Judith Farbey advises clients in the UK and abroad on immigration, public law, human rights and extradition issues. She has an extensive prison law practice and has appeared in numerous national security cases as a Special Advocate. Her specialist immigration practice includes work and business applications. She has developed a niche practice in all aspects of sponsor licensing.

She undertakes Leading Junior work.

Having been described in Chambers & Partners 2010 as "one of the cleverest and most user-friendly members of the Bar" and a barrister that "is great at absolutely everything, from providing urgent advice on the points-based system to complex appeal work and extradition matters", she is also ranked by the Legal 500.

Cases include:

  • Porter and Nanyakkara v Queen's Medical Centre (Nottingham University Hospital) [1993] IRLR 486 on the transfer of undertakings in the employment law context
  • Kagema v Secretary of State for the Home Department [1997] Imm AR 137 on the meaning of persecution under the Refugee Convention
  • Malaysian Industrial Development Authority v Jeyasingham [1998] ICR 307 on sovereign immunity in unfair dismissal proceedings
  • R (on the application of Akhtar) v Governor of Newhall Prison [2001] ACD 69; The Independent, April 30, 2001 (CS) on sentencing provisions
  • McPherson v Secretary of State for the Home Department [2002] INLR 139 on effective protection under the European Convention on Human Rights
  • Secretary of State for the Home Department v MB [2006] HRLR 37, the first control order case to be heard in the High Court
  • MT (Algeria) v Secretary of State for the Home Department [2008] 2 WLR 159 on deportation on grounds of national security
  • AS & DD (Libya) v Secretary of State for the Home Department [2008] EWCA Civ 289.

Judith has presented papers on public law and human rights issues in a variety of forums, including the Centre for Responsibilites, Rights and the Law at the University of Sussex and (over a number of years) the University of Essex's Refugee Care MA course. At the European level, she has spoken on human rights law at conferences organised by ECRE and the Council of Europe.

As an executive member of ILPA, she convened its Access to Justice Sub-Committee from 2001 to 2005. Other activities for ILPA have included parliamentary and policy work on primary and secondary legislation, from blue skies thinking to detailed drafting - numerous of her proposed amendments to draft secondary legislation have been incorporated into statutory instrument.

Judith is a member of the Bar Law Reform Committee and (in 2007) was a member of the Bar Working Group on the role of the Attorney-General. She is a longstanding member of the Editorial Advisory Board of Tottel's Journal of Immigration Asylum and Nationality Law. She is also a member of the Administrative Law Bar Association, Prisoners' Legal Rights Group and Foreign National Prisoners Network.

Judith had a scholarship in Classics as an undergraduate and went on to win a Visiting Fellowship in Philosophy at the University of Princeton, New Jersey.

She was the first winner of the Bar Pro Bono Award in 1997.
