Overview

Kate has a broad civil practice in international and European human rights law, employment and discrimination law, actions against the police, and prisoners' rights.

Areas of Practice

International and European law

Kate was led by Edward Fitzgerald QC in Mangouras v Kingdom of Spain (Application no. 12050/04) before the Grand Chamber of the European Court of Human Rights. The application challenged the decision of the Spanish Government to set a bail security at 3,000,000 Euros as a breach of Article 5(3) of the European Convention. She also was junior counsel in the case of M.S. v United Kingom (Application no. 24527/08) concerning the detention of a mentally ill person in a police cell. Judgment is pending.

In 2010, Kate was awarded a Pegasus Scholarship by the Inns of Court. From June to September 2010, Kate was working at the National Security Project and Human Rights Department of the American Civil Liberties Union in New York. She was involved in a case challenging the United States government's use of unmanned aeroplanes ("drones") to target suspected terrorists abroad: Al-Aulaqi v. Obama. Kate was also led by Geoffrey Robertson QC in a hearing relating to former Guantanamo detainee Binyam Mohamed. They were instructed to appear on behalf of the US media organisations: R (on the Application of Binyam Mohamed) v Secretary of State for Foreign and Commonwealth Affairs [2009] EWHC 2529 (Admin).

Employment, professional discipline, and discrimination law

Kate regularly appears in employment tribunals and the Employment Appeal Tribunal in relation to claims for unfair dismissal, TUPE transfers, and breach of contract. In September 2010, Kate successfully defended an appeal before Employment Appeal Tribunal in relation to a dismissal for gross misconduct: TDG Chemical Ltd v Benton UKEAT/0166/10/DM. In November 2011, she successfully appealed a decision in the EAT regarding when a Respondent can seek to join another Respondent without the Claimant's consent: Beresford -v- (1) Sovereign House Estates Limited (2) Mrs Humphries UKEAT/0405/11/SM. Kate is also regularly instructed to represent employees at mediations in relation to employment disputes.

Kate has also been instructed in a number of employment cases involving age, disability, sex, and race discrimination. In 2011, she successfully represented a claimant who sued British Gas for disability discrimination (Ware v British Gas, Cardiff ET), and successfully represented a claimant who sued her former employers for disability discrimination (Harris v Prospect, Cardiff ET). In addition to employment matters, Kate is regularly asked to advise on claims involving discrimination within prisons, and discrimination in the provision of services.

Kate regularly appears before the Conduct and Competence Committee of the Heath Professions Council, the Nursing and Midwifery Council, and the General Social Care Council. She also appears in the High Court in relation to appeals from the various regulatory bodies: Mohammed v NMC [2009] EWHC 1057 (Admin).

Prison law and civil actions against the police

In November 2010, Kate represented Debbie Collister at the inquest examining the circumstances of her son's death at HMP Camp Hill. The jury returned a critical narrative verdict, highlighting a number of failings by the prison. See INQUEST's press release: http://www.inquest.org.uk/

Kate is regularly instructed to appear at parole board hearings. She has also been instructed to advise on grounds for judicial review in relation to a number of different areas of prison law, and civil claims relating to discrimination within prisons.

Kate appears for claimants in civil actions against the police in relation to claims for assault, false imprisonment, malicious prosecution, misfeasance in public office, and violations of the Human Rights Act 1998.

She has also advised on civil actions against the police in relation to assault, false imprisonment, malicious prosecution and violations of Article 3 and Article 8.
