Overview

Kate has a broad civil practice in international and European human rights law, employment and discrimination law, actions against the police, and prisoners' rights.


Awards

Kate has recently been awarded a Pegasus Scholarship by the Inns of Court. From June to September 2010, Kate will be working at the National Security Project and Human Rights Department of the American Civil Liberties Union in New York.


Areas of Practice

International and European law

Kate was led by Edward Fitzgerald QC in Mangouras v Kingdom of Spain (Application no. 12050/04) before the Grand Chamber of the European Court of Human Rights in late September 2009. The application challenges the decision of the Spanish Government to set Mr Mangouras' bail security at 3,000,000 Euros as a breach of Article 5(3) of the European Convention. Judgment is expected in late 2010.

Kate has drafted a number of other applications to the European Court of Human Rights on Articles 3 and 8.

Kate was also led by Geoffrey Robertson QC in a hearing relating to former Guantanamo detainee Binyam Mohamed. They were instructed to appear on behalf of the US media organisations: R (on the Application of Binyam Mohamed) v Secretary of State for Foreign and Commonwealth Affairs [2009] EWHC 2529 (Admin).

Kate is currently acting as Edward Fitzgerald QC's junior in a case before the Privy Council relating to an appeal against a murder conviction.


Employment, professional misconduct, and discrimination law

Kate regularly appears in employment tribunals in relation to claims for unfair dismissal, TUPE transfers, and breach of contract. She has appeared on several occasions on behalf of members of the United Road Transport Union.

Kate has also been instructed in a number of employment cases involving age, disability, sex, and race discrimination. In addition to employment matters, Kate is regularly asked to advise on claims involving discrimination within prisons, and discrimination in the provision of education.

Kate is also regularly instructed to represent employees at mediations in relation to employment disputes.

Kate also regularly appears before the Conduct and Competence Committee of the Heath Professions Council. She recently appeared in the High Court appealing the decision of the Nursing and Midwifery Council to strike off a nurse after she was convicted of a criminal offence: Mohammed v NMC [2009] EWHC 1057 (Admin).


Prison law and actions against the police


Kate is regularly instructed to appear at parole board hearings and prison adjudications in relation to disciplinary issues. She has been instructed to advise on grounds for judicial review in relation to a number of different areas of prison law, in particular on race and disability discrimination within prisons.

She has also advised on civil actions against the police in relation to assault, false imprisonment, malicious prosecution and violations of Article 3 and Article 8.
