Overview Louise's practice includes a wide range of civil work, with a particular interest in human rights law, principally in the areas of discrimination and equality. Her practice to date has focused on employment law. Areas of Practice Employment, professional misconduct, and discrimination law Louise has a depth of experience of both advisory work and representation in the field of employment law, with a particular emphasis on discrimination law. She regularly appears in the Employment Tribunal and her appellant practice includes the EAT and the Court of Appeal. Louise''s experience of acting in employment matters covers a broad range of issues including unfair dismissal, WTR, TUPE, whistle blowing and all discrimination matters, including representing members of UNITE and UNISON. At appellant level she has recently successfully represented in the following matters:
Most recently she has appeared in the Court of Appeal in the case of Fuller v London Borough of Brent, a case concerning whether the employment tribunal had fallen into the ''substitution mindset'' when assessing the fairness of a dismissal. Louise also has advised on discrimination law outside of the employment sphere, including in the areas of goods and provision of services and education and acts in a pro bono capacity for the Employment Law Association Advisory scheme (ELAAS) appearing in the EAT. In addition, Louise has experience in the field of regulatory law, in particular appearing in professional disciplinary proceedings. Personal Injury Louise has extensive experience of all aspects of personal injury including road traffic accidents, employer''s liability, product liability, fatal accidents and psychiatric injury. She has a particular interest in stress at work claims, having recently represented in a sexual harassment claim, based on the Protection from Harassment Act 1997. Louise has experience in all forums relevant to personal injury; including the High Court, Coroner''s Inquests, Costs Hearings and Criminal Injuries Compensation Appeals. She accepts instructions at all levels of the fast track and multi track and her practice encompasses work at all stages of the litigation process from pre-issue advisory work, through to post-judgment costs assessments and appeals. Education Louise's education law practice includes regular appearances on behalf of children and families in the First-Tier Tribunal (Special education needs and disability). Louise has acted for parents, LEAs, schools and universities. Louise has advised on all aspects of education law, including admissions, exclusions, educational negligence and behaviour and discipline. She has a particular interest in and experience of disability discrimination and has experience of such claims in both the county court and SENDIST (as was). Louise's experience to date includes having advised the DCSF on the content of the new School Admissions Code and the School Admissions Appeal Code. Louise has experience of advising on judicial review challenges in this area. Background Prior to joining Doughty Street, Louise worked as an advisor and tribunal representative for the London Borough of Brent''s Citizen''s Advice bureaux where her work focused on housing and employment law. She undertook an internship for the Centre of Capital Punishment studies, working in Malawi for CHREAA, a local NGO, in partnership with Open Society, South Africa, assisting the Paralegal Advisory Service with their legal education workshops in prison. More recently Louise returned to Malawi and undertook a trial observation in Malawi of the case of Rep v. Chimbalanga and Monjeza, who were facing prosecution for allegedly engaging in homosexual acts. Louise has provided training across a wide range of areas relating to discrimination including compensation, defining PCPs, the scope of reasonable adjustments and special education needs. She has lectured on the impact of recent European jurisprudence on the interpretation of the WTR 1998 and rights in conflict; focusing on religious discrimination. In October 2010, Louise acted as a judge for the African Human Rights Mooting Competition, a continent wide mooting competition held in Benin. Louise also provided advocacy training for the moot participants.
