Paul Bogan is a specialist defence advocate in Criminal Law. His practice encompasses fraud, offences of serious violence, drug trafficking and money laundering. For several years he has been instructed as leading counsel. His fraud experience includes the Jubilee Line and Polly Peck cases. He has defended in cases involving mortgage fraud, VAT / carousel / missing trader fraud, bank fraud and a variety of Companies Act and insolvency offences. He has recently concluded an 8 month conspiracy trial (Halai & others) involving the importation and distribution of counterfeit Viagra in which several defendants were charged with offences under Medicines and Trademark legislation. At the Central Criminal Court he has led in the defence of clients accused of murder: defendant killing his brother (R v Benson); a defendant killing his wife (R v Sharifzadeh) gang attack (R v Roberts): defendant killing neighbour (R v Theophilou). An experienced advocate in the Court of Appeal, several his cases have been reported, including R v Houlden (jury unanimity as to basis of guilt: Archbold 4-393); R v McGuigan and Cameron (actus reus of violent disorder: 29-15); R v Forsyth (mens rea of handling stolen property and video link evidence from abroad: 21-311). In the Privy Council he has represented a number of Caribbean prisoners in appeals against their convictions for murder. He also represented a Greek Cypriot charged with drug smuggling in a politically sensitive trial in Northern Cyprus. He recently co-authored Blackstone's Guide to the Proceeds of Crime Act 2002 (OUP), published in April 2008. In 2004 he published Identification: investigation, trial and scientific evidence (LAG), a comprehensive text on identification procedures and evidence in criminal trials. Some years earlier he was the assistant author of The Criminal Court in Action (Butterworths). He has also lectured on identification evidence, hearsay evidence and conducted seminars on the Proceeds of Crime Act 2002. He is an elected member of the Bar Council and currently sits on their Law Reform and Public Affairs committees. He is a committee member of the Criminal Bar Association and was previously an elected council member (and former Treasurer) of Liberty for whom he drafted a number of responses to proposed changes in Criminal Law. last updated April 2008 |
