RAF Squadron Leader acquitted of sexual assault charge

Squadron Leader Kai Macnaughton, 42, was found not guilty in a unanimous decision by a jury after less than an hour's deliberation. Macnaughton was defended by Kirsty Brimelow QC.►►

Decision to discontinue stalking prosecution unlawful

In a landmark ruling, the Divisional Court has held that the decision by the CPS to discontinue the prosecution of a stalker for breaching a restraining order was unlawful and breached his victim's Article 8 ECHR rights. Ms Waxman was represented by Ian Wise QC and Steve Broach.►►

Rwanda journalists jailed for genocide denial launch Supreme Court Appeal

John Jones and Holly Scott-Mason, together with Media Legal Defense Initiative and local lawyers, have launched an appeal in the Rwandan Supreme Court against the convictions and sentences of two Rwandan journalists jailed for genocide denial, criminal defamation, divisionism and threatening the national security. ►►

Mr Davies, 81, and Mrs Ross, 82, have been together for about 20 years and in that time have enjoyed numerous cruise holidays. She had begun to suffer memory loss and was admitted to a council-run care home in Cardiff last July. The couple had a cruise booked for October and Mrs Ross wanted to go. The council decided that Mrs Ross was "found to lack capacity to make a decision" about whether or not she should go on the holiday. Stephen Reeder appeared for Mr Davies and persuaded the Court of Protection to allow the couple to cruise. ►►

Former Kenyan Minister for Industrialisation cleared of Crimes Against Humanity

Steven Powles together with Matthew Ryder QC and Michelle Butler of Matrix Chambers were part of a team working with Kenyan lawyers representing former Kenyan minister for industrialization, Mr Henry Kosgey, who faced allegations of Crimes Against Humanity before the International Criminal Court in The Hague. ►►

The EHRC finds violation of Article 6 in Othman v UK

The European Court of Human rights this morning delivered its judgment in the case of Othman v UK. The court found that the applicant's deportation to Jordan would be in violation of Article 6 of the Convention on account of the real risk at the applicant's retrial of the admission of evidence obtained by torture of third persons. Mr Othman was represented by Edward Fitzgerald QC of Doughty Street Chambers. ►►

Court of Appeal grants permission to appeal against latest Zimbabwe Country Guidance

In JG & CM (Zimbabwe), the Court of Appeal has granted permission to appeal against the current Zimbabwe Country Guidance, issued by the Upper Tribunal in EM and Others (Returnees) Zimbabwe CG [2011] UKUT 98(IAC), a case affecting potentially thousands of Zimbabweans seeking asylum in the UK. Counsel for both appellants are Mark Henderson and Laura Dubinsky. Alasdair Mackenzie was junior counsel in the Upper Tribunal and in the first stages of the Court of Appeal proceedings.►►

Staffordshire Police settle claim for failure to stop murder of woman

Staffordshire Police have settled a damages claim for a substantial sum (including costs) following the murder of a young woman, Donna Wilson, by her former boyfriend Shaun Clarke, in 2007. The claim, brought in negligence and under the Human Rights Act, was based upon systemic and individual police failings. This case is one of a series of cases being handled by Nicholas Bowen QC which seek to hold the police and other public authorities liable for murders that were eminently preventable had the requisite degree of professionalism been forthcoming. ►►

European Court of Justice holds that EU Charter of Fundamental Rights binding on UK

The Grand Chamber of the Court of Justice of the European Union (CJEU) has delivered its judgment in the landmark case of Saeedi/NS (C411/10) deciding fundamental questions about Member States' obligations under the EU Charter of Fundamental Rights and whether the Charter binds the UK. At the hearing before the Grand Chamber, Doughty Street barristers Mark Henderson and Alison Pickup appeared for Saeedi/NS, and Geoffrey Robertson QC and Jonathan Cooper for EHRC. ►►

David Burgess murder acquittal

Sen Kanagasingham who was accused of murdering human rights lawyer David Burgess has been acquitted. He had already admitted to manslaughter on grounds of diminshed responsibility. Ed Rees QC of Doughty Street and David Kitson of Sonn Macmillan Walker were the trial counsel for the defence team. ►►

Managing Director Acquitted in Network Rail Multi-Million Pound Corruption Case

Chris Sallon QC, instructed by Simons Muirhead and Burton, recently secured the acquittal of the UK managing director of a multi-national Swiss based company, who had been charged with bribing the former head of contracts at Network Rail in a ten million pound corruption case. The jury returned their verdict after a re-trial lasting 6 weeks. ►►

Victory for fair trial rights in Strasbourg

The Grand Chamber of the European Court of Human Rights delivers the long awaited judgment in Al-Khawaja and Tahery v United Kingdom, finding a violation of the right to a fair trial in Mr. Tahery's case as a result of the admission of decisive hearsay evidence. Mr. Tahery was represented by Rebecca Trowler of Doughty Street Chambers. ►►
