Court of Appeal halves sentence of unrepresented defendant Derek Henry.

Benjamin Newton, instructed by Ameeta Dhanjal of SVS Solicitors, represented Mr Henry, a man of previous good character who had appeared unrepresented before Snaresbrook Crown Court in July 2012 following his guilty plea in the magistrates court. The Court of Appeal quashed the sentence of seven years imprisonment as unlawful pursuant to s83 PCC(S)A 2000 because Mr Henry had been entitled to, and expected, representation at the Crown Court. Having considered submissions that could have been made on the defendant's behalf before the Crown Court had he been represented, the Court of Appeal replaced the sentence with a lawful sentence of three-and-a-half years.
