David Bentley QC acted for a 15 year old who was today cleared of murder, as the prosecution dropped their bid to mount an unprecedented fourth trial. David, instructed by Francis Conteh at McMillan Williams, acted for TD, who was accused of participating (along with one other) in a “joint enterprise” knife attack in south London. After two juries were hung on murder, and a third discharged for legal reasons, the prosecution took the exceptional step of seeking a fourth trial. However, following the lodging of extensive legal submissions relating to the oppressive and unjust effect of a further trial on the welfare of the (child) defendants, that decision was reviewed at the highest CPS levels, and no further evidence offered.
