Disabled Woman Returned Home After Court of Protection Finds Local Council Acted Unlawfully

After a 10 day hearing before HHJ Marston, MK, a young woman with autistic spectrum disorder and no verbal communication skills has been returned home to her family.  The judge found that Somerset County Council acted in serious breach of her human rights by keeping her away from home and that had they acted lawfully she is likely to have returned home within weeks rather than 13 months later by court order.

MK was represented by Aswini Weereratne who was instructed by Polly Sweeney of Irwin Mitchell LLP, with the Official Solicitor as litigation friend. For more information please see here.
