Judicial Review win against Woolwich Crown Court

Joel Bennathan QC wins JR to have a Recovery of Defendant’s Costs Order struck down. His argument focused on whether it was fair for a legally aided defendant who had a count “left to lie on the file” to have to pay his defence costs to that charge, given the presumption that we are all innocent until proven guilty. The Divisional Court found the argument had substance and the Judge at Woolwich Crown Court had simply not addressed the point. Costs against the Lord Chancellor.
