Supreme Court consider the meaning of Article 5 in the context of social care homes

Paul Bowen QC, Ian Wise QC, Steve Broach and Martha Spurrier appear for interveners in the Supreme Court conjoined appeals of P v Chester West and Chester Council and P and Q v Surrey County Council, which will determine the meaning of Article 5 ECHR in the context of social care homes. The Court will consider whether the appellants were deprived of their liberty within the meaning of Article 5 ECHR and the Mental Capacity Act 2005. Paul Bowen QC appears on behalf of the Equality and Human Rights Commission and Ian Wise QC, Steve Broach and Martha Spurrier appear on behalf of Mind and the National Autistic Society. The hearing is listed for three days.
