Systematic Inhuman treatment bars extradition to Moldova

In a final judgment District Judge Zani discharged a former police officer (A) from a request for his extradition by the Government of Moldova after ruling Moldova is unable to abide by its Article 3 Convention obligations.

 

The Court relied on two recent judgments of the European Court of Human Rights against Moldova on Article 3 (Iurca v. Moldova Application no. 33759/10 and Gorea v. Moldova Application no. 6343/11) as well as a range of expert reports. The Court accepted the Strasbourg judgments “appear to demonstrate that the failures in the Moldovan system are regrettably systemic rather than occasional.” Moldova declined to exercise its automatic right of appeal against this ruling.
