Unanimous murder acquittal at Old Bailey for David Bentley QC’s client

CC was this week cleared of murder by a jury in less than 3 hours. The prosecution had alleged that he deliberately stabbed his mother’s ex-partner in the chest. His defence, clearly accepted by the jury, was that the victim had arrived at the home address armed with a knife. When he proceeded to threaten CC with it, CC used a martial arts type move in an attempt to defend himself and disarm his attacker. The stab wound occurred accidentally in the course of a struggle. The court also heard evidence that the victim had a history of violence against ex-partners.
