Health and welfare decisions in Court of Protection cases are invariably dependent on the discharge of statutory duties by relevant public authorities to provide care and treatment for assessed needs.The duties on local authorities will continue under the Care Act 2014.  This seminar will consider the protection of vulnerable, incapacitated adults and the role of the Court of Protection, if any, in obtaining necessary services. It will consider the impact of the Court of Appeal decision in Re MN (an adult) [2015] EWCA civ 411.
