In July 2012, the Home Office substantially amended the contents of the Immigration rules in an attempt to place consideration of Art 8 ECHR within a framework set down in the Immigration rules. This seminar will examine the response, in terms of guidance contained in decisions from the Upper Tribunal, since these major changes in the rules as they relate to deportation. In the light of the 'dual track' that the Upper Tribunal's case law creates, with consideration of Art 8 now required within the Appendix FM structure, and also under the framework of the major Art 8 case law, the Seminar will also look at the current state of relevant domestic and Strasbourg case law, in order to examine where matters actually stand in relation to the approach to be taken to deportation.
