On 21 November 2012 the Supreme Court handed down its landmark judgment on exclusion from refugee status in Al-Sirri and DD (Afghanistan) [2012] UKSC 54. It redefines the proper approach to exclusion on the basis of accusations of involvement in 'terrorism' and the standard of proof to be met in all Article 1F cases. The impact on the increasing use of exclusion in asylum cases is likely to be substantial.

This seminar will explore the current position regarding exclusion under the Refugee Convention and the Qualification Directive with reference to this and other recent cases.

Judith Farbey QC has substantial experience of refugee cases both domestically and in Europe, as well as writing and academic teaching on the Refugee Convention. Alasdair Mackenzie was junior counsel for Al-Sirri and has acted in numerous other exclusion cases before the Tribunal and Court of Appeal.
