All public bodies should aim to practice 'good administration', exercising their public duties speedily, efficiently and fairly. The actions of prison administrators are subject to the same examination and review by the courts as other public bodies, for as the ECtHR stated in Golder v United Kingdom 'justice does not stop at the prison gates'.
 
The Human Rights Act is now 10 years old and a body of law has now been developed by the Courts to supervise public bodies in the exercise of their public functions. Claims for judicial review have and will continue to play an important role in providing a powerful and effective method of ensuring that the improper exercise of power by public bodies including the state itself can be checked and held to account.

This seminar will focus on:

  • Judicial Review Procedure, how to settle and proceed with a typical claim and remedies available

  • Will examine the case law that has been developed specifically around the rights of prisoners.
