This two-part webinar series will discuss the procedural and substantive issues which arise when a party is suspected or assessed as lacking capacity within civil proceedings. The speakers will be barristers from Doughty Street Chambers’ Court of Protection, Housing and Personal Injury teams. The topics discussed will apply across the full range of civil litigation.
Part 1: The procedural pitfalls

In this first webinar, Dominic Preston, Jordan Briggs and Beth Chalcraft will focus on the procedural challenges which arise when capacity is in issue. Topics will include the statutory background, including the Mental Capacity Act 2005 and Rule 21 of the Civil Procedure Rules, as well as the duties of representatives and the court, and tips for obtaining optimal expert reports. The session will be of particular interest to those conducting civil claims arising from personal injury, actions against the police, housing, the Court of Protection and more.
Part 2: Deal with success!

In this second webinar, Christopher Johnson, Rachel Woodward and Jordan Briggs will focus on quantifying and managing damages for a protected party. The session will consider high awards, low awards, and those somewhere in between, and address topics including deputyship, settlement forms, success fees and the effect of damages on social security benefits. The session will be relevant across the full range of practice areas and settlement values, from high value claims arising from personal injury, inquests and actions against the police, to lower value claims arising from housing, mental health and Court of Protection matters.
