Hardial Singh challenges: legal and strategic issues in practice

This session is aimed at those advising clients who are, or have been, detained under immigration powers. We will begin with an overview of the Hardial Singh principles with a particular focus on recent developments in the caselaw, and a consideration of the interaction between these principles and Home Office policy. We will then look at strategic and tactical issues arising in detention challenges brought by reference to the Hardial Singh principles, including evidence gathering, client instructions, timing and procedural considerations.

Level: beginner / intermediate.
