Mandatory Mediation and Local Authorities- Are you ready?

In October 2024 the Civil Procedure Rules changed. Judges now have the power at any time to order parties to use ADR (including mediation). Crucially, the costs provisions have changed too. When judges consider costs orders, they can now take into account a party’s failure to comply with an order for ADR, or unreasonably to engage in ADR. The Court of Appeal has already used this power last year- Northamber v Genee World [2024] EWCA Civ 428.
What does this mean for local authority lawyers, and how can you use the increased pressure to mediate to your advantage- before and after a dispute gets to court?
