Public Law Challenges in Extradition Proceedings: When a Statutory Appeal Cannot Provide a Remedy

Peter Caldwell KC and Graeme Hall will be joined by Katy Smart of Sonn Macmillan Walker Solicitors to discuss the ways in which public law challenges can be used within proceedings under the Extradition Act 2003. The seminar will look at substantive challenges, procedural pitfalls, as well as costs and public funding.
Peter and Katy are instructed in an ongoing judicial review of the Secretary of State’s certificate ordering extradition (R (Mithan & Ors.) v Secretary of State for the Home Department). Graeme recently successfully judicially reviewed a decision of a district judge sending his client’s case to the Secretary of State (Dooley [2025] EWHC 3448 (Admin)).
