Acquittals in third and final Fortnum and Mason protest trial

Benjamin Newton and Annabel Timan (instructed by Mike Schwarz at Bindmans LLP) have secured the acquittals of four protestors and one legal observer who had been charged with aggravated trespass at Fortnum and Mason's. Nineteen other defendants are challenging convictions from earlier trials, but in the third and final trial of those selected for prosecution from the 145 originally arrested, District Judge Purdy found that he could not be sure that any of the defendants had the requisite intention to intimidate. He relied heavily upon live evidence called by the defence from John McDonnell MP and the distinguished journalist Polly Toynbee, both of whom praised the non-violent innovative style of demonstration that has been characteristic of UK Uncut actions.
