Court clarifies duties of those sponsoring and carrying out clinical trials

Judgment was today handed down by the Hon Mr Justice Jay in the case of R (Richmond Pharmacology Limited) v The Health Research Authority [2015] EWHC 2238 (Admin). Jonathan Price acted for the interested party, the charity Sense About Science, instructed by Robert Dougans of Bryan Cave. The judgment helpfully clarifies the duties on those conducting or sponsoring phase 1 clinical trials in the United Kingdom, and sets out the HRA’s remit in relation to ensuring good clinical practice and in the promoting of ethical principles in clinical trial research. In both cases the HRA must perform its oversight functions with clarity and transparency.
