Court of Appeal rules on tenancy deposit provisions.

The Court of Appeal has today ruled that a private tenant is entitled to the protection of the tenancy deposit provisions in Part 6 Housing Act 2004, even though his deposit was paid before those provisions came into effect: Superstrike v Rodrigues [2013] EWCA Civ 669.   The ruling may assist any tenant who remains in occupation under a statutory periodic tenancy which has arisen since April 2007.  The tenant Mr Rodrigues was represented by Martin Westgate QC and Ben Chataway of chambers.
