High Court allows extradition appeal of Lithuanian father

The High Court today allowed the appeal of a 24 year old Lithuanian man who had argued that enforcing a 19 month custodial sentence imposed for 2 burglaries committed in 2008 would have a disproportionate impact on the Appellant’s and his family’s Article 8 rights.  Mr. Justice Ouseley found that the delay of over a year in hearing the appeal was one of the relevant factors which tipped the balance.  Considering all of the circumstances, extradition would constitute a disproportionate interference with the right to family life.
