High Court intervenes to prevent a senior Metropolitan police officer escaping the reach of disciplinary proceedings through resignation

Wilkie J has granted permission for the Claimant to bring a judicial review of a decision made by DAC Taylor earlier this month to permit the Inspector at the heart of the case to resign and intervened to prevent him resigning pending the full hearing.  The Inspector faces criminal charges of assault and conspiracy to pervert the course of justice. The judicial review will consider whether Article 3 of the ECHR requires that the processes should  be capable of resulting in disciplinary findings against the officer.
