Hospital Order with Restrictions imposed for Manslaughter (Diminished Responsibility)

Benjamin Newton KC and Jessie Smith, instructed by Sevim Tonbul of Morgan Has Solicitors, represented GT who had killed his partner in 2024. In December 2024 the prosecution accepted the defendant’s plea to manslaughter based upon psychiatric evidence that he had been suffering from undiagnosed schizophrenia at the time. Sentence was thereafter adjourned while he was transferred to a psychiatric hospital and further reports were obtained, and finally took place on 22nd August and 1st September 2025. The sentencing judge accepted the defence submissions that the defendant’s retained responsibility was at the lower level and that a s37/41 MHA hospital order with restrictions was appropriate rather than a s45A hybrid order.
