Writ of habeas corpus issued & Claimant’s costs ordered in full against the Defendant, a Prison Governor
A Judge of the High Court having decided to grant the Claimant bail, the Defendant, a Prison Governor, failed to release the Claimant the same day. In the very early hours the next morning, solicitors for the Claimant issued a claim for a writ of habeas corpus and this led to an out-of-hours application for the writ. Abigail advised on, and drafted, the statements of case and schedule of the Claimant’s costs that accompanied the claim form. The Judge ordered the Defendant to pay all costs sought by the Claimant’s solicitor and counsel.
