Reliance on Article 8 to prevent deportation or removal remains one of the most hotly contested battlefields of immigration law. This seminar will consider recent domestic and European jurisprudence on the circumstances in which the rights to respect for private and family life can be relied on to prevent expulsion, including detailed consideration of the complex interplay between the Immigration Rules and the Article 8 caselaw.
