The Care Act 2014 – Human Rights and Safeguarding

Following the coming into force of the Care Act 2014 on 1 April 2015, this seminar will look at the human rights and safeguarding obligations imposed by the Act. The seminar will cover safeguarding principles, practice and processes as well as the human rights issues that typically arise in the community care context. The speakers will explore the interaction between human rights and safeguarding, identifying emerging themes in domestic and European human rights law on the positive and investigative obligations under Article 3 ECHR in the social care context and considering the role of public law, private law and Court of Protection proceedings in this area.
