Government “broke law” with new protest powers, Court told

On 28 and 29 February 2024, the Divisional Court (Green LJ and Kerr J) heard Liberty’s challenge to protest regulations introduced by the former Home Secretary, Suella Braveman. The regulations purport to introduce a new definition of “serious disruption to the life of the community” even though a proposed amendment to the same effect had been rejected by Parliament.  The Court was told that this was a “constitutionally unprecedented” step. Judgment has been reserved.
