Arbitration in a World in Flux: Armed Conflict, Environmental Harm and the Rule of Law

 

In Arbitration in a World in Flux, Aarif Abraham, commissioned by LexisNexis University, looks at what increasing armed conflict, environmental catastrophe and the proliferation of rights violations means for investments but also what it means for States in which investments are made. 

 

He addresses what the key considerations are in an increasingly uncertain world for States to fulfil their international obligations and for investors to safeguard their rights. Critically, however, he highlights the shortcomings of investment arbitration in safeguarding those who are often cut out of the arbitration process: communities concerned about the environment, the public at large, and victims/survivors of international crimes or rights violations – what are the obligations/responsibilities on investors beyond their rights? 

 

Aarif makes suggestions to navigate these complexities, propose strategies for successful case outcomes and - longer term - the need for serious reform.
