This seminar provides an essential overview and update on challenging the hostile environment as it applies to EEA nationals in the lead-up to probable Brexit. It will address 1) abuse/misuse of rights; 2) detention and bail (including limitations on section 4 accommodation); 3) deportation; and more briefly, 4) employment restrictions. We will consider the 2016 EEA Regulations and important developments in the caselaw of the Court of Justice and domestic courts as well as Home Office policy affecting those four areas. The seminar is aimed at solicitors and NGOs acting on behalf of EEA nationals and assumes some knowledge of fundamental aspects of EU law.
