Amelia Nice successfully appeals an order for extradition

On 17 January 2019, in Marjanowski v Poland, Amelia Nice won an extradition appeal representing a requested person’s sought in Poland for a minor fraud offence. On appeal, the court accepted that the District Judge had misdirected himself in law and that the requested person’s recent arrival in the UK did not amount to an exceptional circumstance under Practice Direction (CA (Crim Div): Criminal Proceedings: General Matters) para.50A.4, that would render proportionate his extradition for a minor fraud offence.
