In December 2022 the Court of Appeal to hear appeal in relation to levels of social security paid to recipients of “legacy benefits”

On a date to be fixed between 6-8 December 2022 the Court of Appeal will hear the appeal in R (T, Wayland, Barrow and Keatings) v. Department for Work and Pensions. The case concerns the decision during the pandemic to not raise benefit levels for approximately 2m people on Job Seekers Allowance, Income Support and Employment Support Allowance in line with the temporary increase that was given to recipients of Universal Credit. The High Court found the decision discriminated against disabled people but was justified. The legacy benefit claimants are represented by Jamie Burton KC, leading Desmond Rutledge of Garden Court Chambers, instructed by Osbornes Solicitors.
