The Doughty Street Administrative and Public Law Team Response to the Independent Review of Administrative Law is published today.

The Team at Doughty Street highlight the crucial constitutional function of judicial review and regret the fundamental asymmetry of the Review.  The Terms of Reference and the questions posed in the Call for Evidence appear to suggest that the executive should be better sheltered from legal challenge. This would be a grossly illiberal step leaving citizens vulnerable to arbitrary and unlawful action.

The Response focuses on the reality of judicial review for claimants; the significant barriers which already limit access to the courts and the important role which judicial review plays in protecting the rights of vulnerable people and marginalised communities.
