Doughty Street Chambers Public Law Team Members Respond to Judicial Review Consultation

Judicial review is a fundamental part of our constitution and is a vital element of the rule of law. The principle that public bodies must act lawfully and are subject to supervision by the courts is central to any functioning democracy.

The consultation proposals represent fundamental changes to judicial review which have significant implications for the rule of law and the constitution. The proposals are backed by explanations and descriptions of judicial review and its place in the constitution which are not supported by evidence and which are unrecognizable to many lawyers active in this field.

It is a matter of grave concern that the Government appears determined to implement wholesale change to judicial review in furtherance of its own interests and without a proper evidential basis.
