Extradition to Ukraine refused
The extradition of Mr Artem Dmytruk, a member of the Ukrainian Parliament and supporter of the Ukrainian Orthodox Church, has been refused by SDJ Goldspring. Mr Dmytruk’s extradition was sought in respect of two allegations of assault.
Extradition was refused on the grounds of a disproportionate interreference with Mr Dmytruk’s right to respect for private and family life under Article 8 ECHR. This was in the context of the Judge’s findings that Mr Dmytruk had been tortured whilst detained by the SBU (the Ukrainian Security Service) in March 2022.
Edward Fitzgerald KC acted for Mr Dmytruk with Ben Joyes of 9BR. They were instructed by Katy O’Mara of Hodge Jones & Allen Solicitors.
