Farrhat Arshad’s client acquitted by jury following finding of unfitness

Farrhat’s lay client was charged with three counts of making indecent images.  Following reports from two Defence psychiatrists and a Prosecution psychiatrist, a judge at Kingston Crown Court found him unfit to plead or stand trial.

The Prosecution pursued a section 4A Criminal Procedure (Insanity) Act 1964 hearing, as to whether the defendant “did the act” alleged.  On 5 July 2022, in the absence of the defendant, a jury was sworn at Kingston Crown Court to try this issue.  Having heard the evidence, the jury found they could not be sure the defendant “did the act” alleged and acquitted the defendant of all three counts.
