Government of India refused leave to appeal following quashing of extradition order by High Court
After a successful appeal to the High Court which that Mr Bhandari’s extra doom to India was barred by the high risk of torture in police custody; the risk of suffering violence in prison; and the risk of a flagrant denial of justice at trial. The Indian Government sought a certificate for permission to appeal to the Supreme Court. Following submissions by Edward Fitzgerald KC and James Stansfeld and Robbie Stern of Matrix Chambers, the High Court refused permission and refused the Indian Government’s application for an oral hearing.
Edward Fitzgerald KC told the Times of India: “We are very relieved that the appeal has succeeded and that the Government of India’s application for leave to appeal further to the Supreme Court has been finally refused. In the absence of a certificate from the High Court, the Indian Government can now appeal no further. It is all over. So now, at last, Mr Bhandari can get on with his life.”
