Hungary v SB

On 21 December 2020, Deputy Senior District Judge Ikram discharged SB from a European arrest warrant issued by Hungary  on the basis that extradition would amount to a disproportionate interference with his human rights and those of his children.  SB’s partner was profoundly hearing impaired, functionally learning disabled and they had 3 young children. SB’s deportation had been recently refused.  It was submitted that should extradition go ahead, the children would inevitably and necessarily be taken into foster care.    The Judicial Authority did not appeal. The Judge granted the application to anonymize the case.
