Jonathan Lennon acts as £1.2M Account Freezing Order set aside

Jonathan Lennon, instructed by and working with Rosenblatt Solicitors, secured the agreed set aside of an AFO secured by West Yorkshire Police against a company the WYP suspected were involved in fraud and violations of Financial Conduct Authority regulations.

A strong factual defence was mounted, together with a Skeleton Argument arguing  a number of procedural defects in the securing of the AFO at a without notice hearing, continuing breaches of the duty of disclosure, as well as there being no prospect of the statutory tests for forfeiture ever being likely to be met.  On 23rd March 2021 the Leeds Magistrates’ Court set aside the order by consent.
