Man acquitted of failing to provide information and speeding
PM was charged with failure to provide information and speeding, his car having been going at 48 in a 40 zone.
The police sent him a NIP, a reminder and subsequently a final reminder. The final reminder was sent two months after the alleged offending, therefore outside of the 28 days that a driver usually has to respond to such a notice. PM had replied to the NIP (albeit the police contended they had never received any response) following the first reminder and he had proof of postage. This response was outside of the window, but in the circumstances and following robust defence submissions, the Crown offered no evidence in respect of both counts and formal verdicts of not guilty were recorded.
