Nicholas Bowen QC successfully resisted the local authority’s application to strike out

AA and BB  v CC (judgment linked below) concerns “failure to protect” claims v. local authorities following the decision of the Supreme Court in CN v Poole. Nicholas Bowen QC, instructed by Bhatia Best, successfully resisted the local authority’s application to strike out, arguing that the conduct of the local authority amounted to causing harm (making things worse), or, alternatively, that the local authority had assumed responsibility to the claimant.
