Successful modern slavery defence in PWITS A case
SD, who had been trafficked to the UK at 17 years old, under the pretence of a job offer, was charged with three counts of possessing Class A drugs with intent to supply. On the final leg of his journey, the small boat he arrived on was intercepted by the authorities and initially, he was placed in care. However, he later became a missing child. During this time, he was forced to sell, prepare and transport drugs across the country by his original exploiters. He was beaten and threatened, and threats were made against his family. He was arrested in possession of a large quantity of money, and 4kg of cocaine, having been found in a property alongside another missing child.
A prepared statement was given at interview, highlighting the exploitation. The defence further commissioned reports in respect of modern slavery and a positive reasonable grounds decision was received. A week before the trial was due to commence, the prosecution offered no evidence on all three counts, allowing SD to begin to rebuild his life.
