Court finds no allegations of anti-social behaviour proven in application to enforce a suspended possession order

Cara Hall represented the Defendant, JR at a fact-finding hearing in relation to an application by her social landlord to enforce a suspended possession order on the basis that she had breached the terms of the order by engaging in further anti-social behaviour.

Following a one-day fact-finding hearing and skilled cross examination by Cara Hall of the Claimant’s staff and JR’s neighbours, the Court found that the Claimant had not proven any of the allegations relied upon and dismissed the application. The Judge held in any event that even if he had been satisfied that any of the allegations were proven, he would have in any event further suspended the order on terms.
