Edward Fitzgerald QC and Jonathan Price successful in application to the High Court for permanent lifetime anonymity orders for claimants convicted of murder whilst children aged 13 and 14

Edward Fitzgerald QC and Jonathan Price have been successful in their application to the High Court for permanent lifetime anonymity orders in respect of claimants ‘D’ & ‘F’, who were convicted of murder in 2016 and sentenced to detention for life, with a minimum term of 15 years.

At the hearing Edward Fitzgerald QC and Jonathan Price argued that both teenagers suffer from “recognisable mental conditions” and were "extremely psychologically vulnerable".  On granting the injunction, the Honourable Mrs Justice Tipples accepted that Articles 2 and/or 3 were engaged “in relation to the risk of suicide and self-harm”.  She further found that revealing D & F’s identities was “likely  to cause each of them very serious harm and interfere with their article 8 rights”.

Edward Fitzgerald QC and Jonathan Price were instructed by Jennifer Twite of Just for Kids Law on behalf of D, and by Jane Ryan of Bhatt Murphy Solicitors on behalf of F.
