Graeme Hall defeats Greek extradition request
On 27 February 2024, District Judge Clarke discharged BI from a Greek extradition request. The request alleged that BI was part of an organised criminal gang in Greece involved in defrauding elderly victims out of in excess of €120,000.
The Judge described the offending as “very serious”. However, on the basis of expert medical evidence going to BI’s mental health and fitness to plead, the Judge concluded that extradition would be a “wholly disproportionate” interference with BI’s Article 8 ECHR rights. Further, the Judge concluded that extradition would be oppressive to his health, contrary to section 25 of the Extradition Act 2003.
